TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of midisposal.org (the "Site") and the junk removal, hauling, and disposal services ("Services") provided by Michigan Disposal and Junk Removal ("MIDisposal," "we," "us," or "our"). By using the Site or booking Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1. Eligibility
You must be at least 18 years old and legally able to enter contracts. When booking on behalf of a household, business, or property, you represent that you are authorized to do so and to allow removal of the items identified.
2. Services
MIDisposal offers junk removal, hauling, cleanouts, and related disposal services in our service areas in Michigan. Service availability, timing, and pricing may vary by location and are subject to change. Arrival windows are estimates, not guarantees.
3. Third-Party Partners
MIDisposal partners with independent third-party service providers, contractors, haulers, technology vendors, and booking platforms to help facilitate our operations. This includes, without limitation, independently owned hauling crews and subcontractors who perform pickups on our behalf; licensed landfills, recyclers, and donation facilities that receive hauled items; payment processors; communication providers; and dispatch marketplaces such as Trashed.
You acknowledge that some or all of your job may be performed by one of these partners. We select partners with reasonable care, but we are not responsible for acts, omissions, or independent conduct of third parties outside our direct control, except to the extent required by law. Your use of third-party platforms is also subject to their own terms and policies.
4. Quotes, Pricing, and Payment
- Quotes are estimates based on information you provide. Final pricing is determined on site and depends on volume, weight, item type, access, labor, and disposal fees.
- Additional charges may apply for hazardous materials, excess weight, stairs, long carries, after-hours service, or items that require special handling.
- Payment is due upon completion of the job unless otherwise agreed in writing. Accepted methods may include major credit/debit cards and other methods we designate.
- Late payments may incur interest at the lesser of 1.5% per month or the maximum permitted by law, plus reasonable collection costs.
5. Prohibited & Restricted Items
Without prior written approval, we do not haul hazardous materials (e.g., asbestos, chemicals, fuel, oil, paint, biohazards), explosives, ammunition, radioactive materials, or items restricted by law. If prohibited items are discovered on site, we may refuse service and charge for the trip. You are responsible for accurately disclosing the contents of any load.
6. Customer Responsibilities
- Ensure safe, legal access to the items and to the property, and obtain any required permits or HOA/property-manager approvals.
- Confirm all items placed for removal are intended to be hauled. Items removed are presumed abandoned by you; we are not responsible for items mistakenly included.
- Disclose hazardous conditions (e.g., pests, structural issues, biohazards) before the crew arrives.
- Keep children and pets clear of work areas during service.
7. Cancellations & Rescheduling
You may cancel or reschedule by contacting us at least 24 hours before your arrival window. Same-day cancellations, no-shows, or inaccessible jobs may be subject to a trip fee. Specific cancellation terms for a job may be disclosed at booking and, if so, control over this section.
8. Property & Damage
We take reasonable care with your property. Minor marks, dust, or wear consistent with moving large items are normal. Claims for damage must be reported in writing to michigandisposal@gmail.com within 72 hours of service, with photos and a description. We may inspect before repair. Our maximum liability for any property damage claim is the lesser of actual documented repair cost or the amount paid for the applicable job, except where a higher amount is required by law.
9. Ownership of Hauled Items
Title to items we haul passes to MIDisposal or its designated partner at the time of pickup. We may recycle, donate, resell, or dispose of hauled items in our discretion.
10. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDISPOSAL AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO A JOB WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT JOB.
12. Indemnification
You agree to indemnify and hold harmless MIDisposal and its partners from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misrepresentation about items or property, or your violation of law.
13. SMS & Email Communications
By providing your phone number or email, you consent to receive service-related messages (including SMS) from MIDisposal and its partners, which may be sent using automated systems. Message and data rates may apply. Reply STOP to opt out of marketing SMS. Consent to marketing is not a condition of purchase.
14. Intellectual Property
The Site, including all content, logos, branding, and code, is owned by MIDisposal or its licensors and is protected by applicable laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
15. Governing Law & Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules. Exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Michigan, and you consent to their jurisdiction.
16. Dispute Resolution
The parties will first attempt to resolve disputes informally by contacting michigandisposal@gmail.com. If a dispute cannot be resolved within 30 days, either party may pursue remedies in the courts identified above, or, where applicable law allows, through small claims court. To the extent permitted by law, both parties waive any right to a jury trial and to participate in a class action.
17. Changes to the Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site or Services after changes take effect constitutes acceptance.
18. Severability & Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, along with the Privacy Policy and any written work orders, constitute the entire agreement between you and MIDisposal regarding the Services.
